Arbitration
Our attorneys have had extensive experience with the arbitration process, arbitrating before the International Court of Claims in Paris, the National Association of Securities Dealers in the United States, and representing clients before mediators in privately initiated, pre-litigation mediations and in mediations which have been ordered by the court.
Our approach to ADR invariably depends on the client’s objectives, the procedural rules of the forum and the specific circumstances of each case. We help our clients define their interests creatively, then design and implement corresponding dispute settlement strategies.
ADR often provides a more cost-effective solution to disputes than traditional litigation proceedings and is less injurious to business relationships.
Mediation
Our attorneys have successfully represented domestic and international clients in resolving commercial and financial disputes in mediation.
Mediation, the most common form of ADR, gives the parties complete control of the resolution of their dispute. It is often a required step — before a matter can be litigated before an arbitrator or the court – but can be sought privately at an earlier stage in the dispute. Under the guidance of a neutral person, the disputing parties are provided with a confidential forum in which to define the issues causing the dispute, and attempt to find a voluntary resolution that is satisfactory to both sides.
